The following Terms and Conditions (the "Terms and Conditions"), and the Privacy Policy govern your purchase of travel-related products and services (collectively, "Travel Products") from Luxury Travel Services LLC ("LTS", "we", "us", "our", or the "Travel Agent").
LTS is a company registered and existing in the State of Delaware, USA and acts in its capacity as ARC accredited agent by distributing Travel Products as an agent of the airlines and other flight consolidators. It has a California CST #2119950-40.
These Terms and Conditions are subject to change by us without prior written notice at any time, in our sole discretion. Any changes to these Terms and Conditions will be in effect as of the "Last Updated" date first written above. Please read these Terms and Conditions carefully before booking/purchasing Travel Products with us. Your continued using our services after the "Last Updated" date will constitute your acceptance of and agreement to such changes.
These Terms and Conditions contain a mandatory arbitration provision that, as further set forth in the Disputes Resolution and Governing Law Section below, requires the use of arbitration for certain matters on an individual basis to resolve disputes. This means that for the matters so concerned you and we are each giving up the right to sue each other in court or in class actions of any kind. In arbitration, there is no judge or jury and there is less discovery and appellate review than in court.
By placing an order for Travel Products, you affirm that you are of legal age to enter into this agreement, and you accept and are bound by these Terms and Conditions. You affirm that if you place an order on behalf of an organization or entity, you have the legal authority to bind such organization or entity to these Terms and Conditions.
You may not order or obtain Travel Products if you (a) do not agree to these Terms and Conditions, (b) are not the older of (i) at least 18 years of age or (ii) legal age to form a binding contract with us, or (c) are prohibited from accessing or using any of the contents, goods or services by applicable law.

Most of our airline tickets are non-refundable.
If you bought a non-refundable ticket, cancellation and refund before or after the departure are not permitted. We will refund a non-refundable ticket (or the value of the unused segment of your trip) to the original form of payment only if the U.S. Department of Transportation regulations requires a refund and ALL of the following conditions are met: (i) the airline cancels your flight or makes significant schedule change and/or significantly delays a flight, so you decide not to travel; AND (ii) the airline acknowledges that you are entitled to a refund; AND (iii) the airline returns your funds to us; AND (iv) you do not accept such refund from us in a form of travel voucher. If a refund is required, the amount refunded will only be for the portion of your payment for the actual airfare. Any other fees charged are not required to be refunded.
If you bought a refundable ticket the cancellation and refund of which are permitted according to the airline fare rules, you must cancel the ticket before the departure to avoid a "no show," and we will refund such refundable ticket (or the value of the unused segment of your trip) to the original form of payment only if ALL of the following conditions are met: (i) the airline acknowledges that you are entitled to a refund; AND (ii) you are not a "no show" (most "no show" bookings are ineligible for any refund); AND (iii) the airline returns your funds to us; AND (iv) you do not accept such refund from us in a form of travel voucher.
Please note that cancellation of reservation does not automatically initiate a refund.
Most of our airline tickets are non-reroutable and non-transferable and non-exchangeable.
Any and all changes to the itinerary are restricted and subject to fare difference and fare rules applicable on the date of change. All exchanges, if permitted according to the airline fare rules, can be made only prior to scheduled departure.
If the airline fare rules allow cancellation and/or exchanges and/or refunds – a service fee will be charged to process any refund and/or exchange and/or cancellation request from you. The service fee in the amount of USD100.00 for domestic flights and USD 200.00 for international flights is charged on a per-passenger, per-ticket basis in the currency of the related booking and is generally non-refundable.
This fee will be collected in addition to any penalties charged directly by the airline and/or recalled by the airline from us. Reservations for tickets to be refunded and/or exchanged must be cancelled at least 24 hours prior to the scheduled departure - – "NO SHOW ticket(s)" will not be processed for refund and/or exchange.
After the tickets are issued, any changes, cancellations or refunds are subject to the restrictions of the airlines' rules. Please pay attention to the fare restrictions of your tickets.
If you need more flexibility with your tickets in terms of refunds, cancellations and exchanges, please select less restrictive fares by contacting our customer service team. Please note that the airlines offer a wide range of fares under different rules, including those that offer exchanges, cancellations and refunds without any restrictions and penalties. The airlines strictly follow their policies, and do not permit exchanges, cancellations or refunds in case the fare restrictions do not allow it.
The airlines determine the restrictions of the fares, and we have no power to override these restrictions. The airlines may change their fares and the availability of the seats on a daily basis. The airlines typically manage their seat inventory through their reservation systems. In most cases, they decrease or increase the seat inventory (and thus the fare availability) based on many factors which may include, for example, reservation cancellations or load factor on certain flights. We cannot predict the fare value, nor can we guarantee that the airlines will not release cheaper seat inventory.
We may issue different types of travel vouchers, including but not limited to refund vouchers, loyalty vouchers, and referral vouchers. Each travel voucher has its own terms and conditions, so be sure to read the terms and conditions contained in the specific voucher itself carefully before accepting or redeeming it. Please note that most of travel vouchers can only be used to book with us.
We accept all major credit/debit cards. You hereby agree, represent, and warrant that the card you pay with is yours or that you have the right to use this card if it's not owned by you. We use stringent safety measures for payment processing and verification. Fraudulent transactions, if any, are reported to the airport security, the airlines and other federal and state law enforcement.
All credit cards must have a verifiable billing address. You further represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay charges incurred by you at the posted prices, including any administrative or other charges hereunder and all applicable taxes, if any.
When certain transactions are determined to be high risk by our systems, we will not process such transactions unless our credit card verification team has determined that it's safe to process. In order to establish validity of such transaction, we may contact you, your bank, or your credit card company.
Most credit card transactions over the phone are recorded and are available as evidence in case of any dispute. You hereby consent to such phone recording. Online credit card transactions are authorized at the time a customer accepts these Terms and Conditions and continue with the purchase.
If your credit card is declined for any reason, we will notify you within 24 hours. Simply submitting the credit card information does not automatically guarantee ticketing. No booking and fare is guaranteed until ticketed by the airlines. We bear no responsibility in the event your credit or debit card is not approved or not charged.
Some banks and credit cards companies may impose fees for transactions. Your bank or credit card company may also impose fees for currency conversion. The currency exchange rate and transaction fee are determined solely by your bank or credit card company on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank or credit card company directly.
Please note that we may use the services of third parties to process your payments.
You have the ability to dispute charges with credit card companies ("Chargebacks"). If you have a question about a charge on your credit card statement, we encourage you to call us prior to disputing a charge with your credit card company, so we may discuss and answer any questions or concerns you may have about the charges. In all cases, we will work with you to resolve your concerns. We reserve the right to investigate, rebut, and dispute any Improper Chargebacks (as defined below) and to recover costs of such Improper Chargebacks from you. We also retain the right to fully cancel any booking in the event of a chargeback related to that booking, whether or not an Improper Chargeback. In the event of an Improper Chargeback, we can file a lawsuit against you in a jurisdiction of our choice and seek damages for your conduct, including attorneys' fees and costs.
We deem the following chargebacks as "Improper Chargebacks":
For greater certainty, we may use information relating to you, including recordings of customer service calls, to dispute chargeback claims from you.
You hereby unconditionally authorize us to charge your credit card with the amount of any chargeback processed by the bank and related to the services or products that have been used fully or partially by you.
You hereby unconditionally authorize us to charge your credit card with the amount of any chargeback fees applied by the bank or credit card company to the chargeback requested by you without merits and subsequently rejected by the bank or credit card company.
The airlines may require you to pay additional fees at the airport if your baggage exceeds certain limitations, such as the number, weight, size, and dimensions of your bags. Some airlines do not offer any free baggage allowance. Baggage allowance policies and baggage fees associated with checked or carry-on baggage vary widely and are subject to change by the airlines at any time. We will provide you with cost of checking up to two pieces of baggage but be advised to check directly with the airline for the latest baggage allowance information.
The flight departure and arrival times and flight numbers shown to you at the time of sale are best estimates only and are frequently subsequently changed by the airlines. We are not responsible for any such schedule changes. Please contact the airlines to verify the current flight information and reconfirm your flights 72 hours prior to your scheduled departure. Failure to use any reservations may result in an automatic cancellation of all continuing and return reservations and suspension of the tickets; please contact us or the airline prior to your scheduled departure to cancel your existing reservation and retain the original value of the ticket, if applicable, subject to the other terms hereof.
The fares are not guaranteed until ticketed. Once the tickets are issued, any changes are subject to fare restrictions and rules.
Please note that we are not responsible for transportation to and from airports and between airports and do not provide hotel accommodation.
Check-in time recommended for all international flights is a minimum of 3 hours before departure time, even if you are traveling on a domestic carrier to another airport and connecting to your international flight. We are not responsible if you miss your flight by being late for check-in or at the gate. If you miss your flight, you should either contact the airline representative at the airport or contact us. If you miss your flight, we will make reasonable efforts to assist you but cannot guarantee a replacement flight. We strongly recommend that you check in online within 24 hours of departure.
International travel documents required for all tickets include a passport, which must be presented for all international flights and valid for at least six months beyond the period of the intended travel. Some countries may require a visa and/or a health card. It is your responsibility to have all necessary travel documents in possession at check-in.
You will need to verify your visa and other travel document requirements for all stops, as some countries may require a transit visa.
Traveling on a one-way ticket may not be allowed to certain destinations. If you intend to travel on a one-way ticket, it is your responsibility to make sure you are eligible.
We do not advise on visa requirements and accept no responsibility for determining your eligibility to enter or transit through a specific country. Please contact the embassy, consulate or other applicable governmental authority of the country you are going to visit or transit through to get up-to-date requirements.
Recommended vaccinations for travel may change and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended vaccinations, take all recommended medication, and follow all medical advice in relation to your trip. You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel entry restrictions. We assume no responsibility for and shall not be liable for unsafe conditions or health hazards including epidemics, pandemics or other illnesses.
Each airline sets its own rules, policies and regulations for minors (definition of "minors" may vary by airline) traveling without adult supervision. Please check directly with the airline for unaccompanied minor age requirements, restrictions and fees. Generally speaking, some airlines may:

If you are on a journey involving an ultimate destination or a stop in a country other than the country of departure, you are hereby advised that international treaties known as the Montreal Convention and the Warsaw Convention (including its amendments) may apply to the entire journey including any portion thereof within a country. Such international treaties govern and, in most cases, limits the liability of carriers to passengers for death or personal injury.

You understand that Travel Agent is not the source or supplier of the Travel Products and acts solely as an agent for the actual supplier of such Travel Products. You have been advised that suppliers (for example, airlines) whose names appear in the information supplied to you are those who are actually responsible for providing the Travel Products you have purchased. You hereby consent to and request the use of those suppliers and agree not to hold us responsible should any of these suppliers:
You hereby accept that we are not responsible for, nor will you attempt to hold us liable for, any injury, damage, or loss, you may suffer on account of any conditions, actions or omissions that are beyond our reasonable control.
You have been advised to use a credit card as this may offer you the opportunity to dispute the charge should a vendor cease operating.
You understand that you may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency. We strongly recommend that you purchase travel insurance.
To the extent permitted by law, you shall defend, release, indemnify and hold harmless us, our affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, assigns, shareholders, and representatives from and against any and all claims, damages, losses, liabilities, causes of action, or demands (including reasonable legal and accounting fees), fines, penalties or other costs or expenses of any kind or nature brought by third parties as a result of, caused by, related to or arising out of (i) your breach or violation, or threatened breach or violation of these Terms and Conditions; (ii) any damage/s caused by you while participating in travel; and (iii) your reservation, booking or purchase of any product and services.
The Transportation Security Administration of the US Department of Homeland Security ("TSA") requires LTS to transmit information collected from you. Providing this information is voluntary but if it is not provided, you may be subject to additional screening or denied ticketing and / or transport. TSA may share information you provide with law enforcement or intelligence agencies or others under its records notice. For more on TSA privacy policies or to view the records notice and the privacy impact assessment, please see the following TSA's web site at TSA.gov.
Please also review the Privacy Policy, which contains information of how we treat and protect your personal data. You acknowledge and agree that by providing us with any personal data, you consent to the transmission of such personal data over international borders as necessary for processing in accordance with our standard business practices and applicable law and regulations. We may also share your personal data with third parties, including but not limited to our affiliate companies, to process or complete bookings and transactions that you have requested. If you object to your information being transferred or used in this way, please stop using our services.
We shall have an opportunity to resolve any matter, dispute or claim relating in any way to any booking, any dealing with call center agent or representative, any provided Travel Product or these Terms and Conditions or Privacy Policy ("Claim") in a quick and fair way. So, before taking any action, you agree to first contact our Customer Support representative at info@deluxeflights.com, and we will do our best to address your concern and your Claim. You hereby agree that you may not commence any arbitration or court proceeding unless we are unable to resolve the Claim within sixty (60) days after we receive your Claim and you have made a good faith effort to resolve your Claim directly with us during that time. If we are unable to resolve your claim within sixty (60) days, then a Claim shall be resolved in accordance with the remainder of this Section of the Terms and Conditions.
Please read this section carefully. It affects your rights and will have a substantial impact on how claims we may have against each other are resolved.
Since LTS is your Travel Agent, the following applies between you and LTS:
These Terms and Conditions as well as any Claim shall be governed and enforced by and construed in accordance with the laws of the State of Delaware, USA, without reference to its choice of law rules. Unless otherwise prohibited by the applicable law, any Claim must be brought within two (2) years from the date on which such Claim arose or accrued.
The exclusive means of resolving any Claim shall be BINDING ARBITRATION administered by the American Arbitration Association (AAA) in the County, City, and State of New York. The one exception to the exclusivity of arbitration is that you have the right to bring an individual claim against LTS in a small-claims court of competent jurisdiction. But whether you choose arbitration or small-claims court, you may not under any circumstances commence or maintain against LTS any class action, class arbitration, or other representative action or proceeding. By using our services in any manner, you agree to the above arbitration agreement. In doing so, YOU GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend any Claim between you and LTS (except for matters that may be taken to small-claims court). YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER CLASS PROCEEDING. Your rights will be determined by a NEUTRAL ARBITRATOR, NOT A JUDGE OR JURY. You are entitled to a fair hearing before the arbitrator. The arbitrator can grant monetary awards similar to monetary damages granted by a court, but you should note that arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings. Decisions by the AAA arbitrator are enforceable in US federal and state courts and may be overturned by such courts only for very limited reasons. Any proceeding to enforce this arbitration agreement, including any proceeding to confirm, modify, or vacate an arbitration award, may be commenced in any court of competent jurisdiction.
In the event that this arbitration agreement is for any reason held to be unenforceable, any litigation against LTS (except for small-claims court actions) may be commenced only in the federal or state courts located within the State of Delaware as the venue of any action. You hereby irrevocably consent to the jurisdiction of those courts for such purposes.
Subject to the above, any arbitration conducted pursuant to these Terms and Conditions shall be governed by the Federal Arbitration Act and any dispute about the interpretation of this arbitration agreement shall be covered by it.
You can decline this arbitration agreement by sending us, within thirty (30) days of first accepting these Terms and Conditions, the arbitration opt out letter, a form of which being set forth at the end of these Terms and Conditions, to the following email: cs@slyluxtravel.com.
You represent and warrant that you are buying the Travel Products for your own personal or household use only, and not for resale.
You may not assign any of your rights or delegate any of your obligations under these Terms and Conditions without our prior written consent. Any purported assignment or delegation in violation of this paragraph is null and void ab initio. No assignment or delegation relieves you of any of your obligations under these Terms and Conditions.
The failure by us to enforce any right or provision of these Terms and Conditions will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of the Travel Agent.
These Terms and Conditions do not and are not intended to confer any rights or remedies upon any person other than you.
We may provide any notice to you under these Terms and Conditions by (a) sending a message to the email address you provide or (b) by posting to the website. Notices sent by email will be effective when we send the email, and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
If any provision of these Terms and Conditions is invalid, illegal, void, or unenforceable, then that provision will be deemed severed from these Terms and Conditions and will not affect the validity or enforceability of the remaining provisions of these Terms and Conditions.
